Terms of Service

1. Acceptance of terms
By accessing or using the Lumen website (lumen-credit.vercel.app) and any related applications or services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, applicants, and account holders. The Service is intended solely for lawful business purposes by adults who have the authority to bind the business entity on whose behalf they are acting.
2. Use of the Service
Permitted use
You may use the Service to apply for a business line of credit, manage an existing account, and access information about our products — provided you comply with these Terms and all applicable laws and regulations.
Prohibited conduct
You agree not to:

- —Attempt to gain unauthorized access to any part of the Service or its underlying systems

- —Interfere with or disrupt the integrity or performance of the Service
Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@sbaloanoptions.com if you suspect unauthorized use of your account.
3. Credit products and applications
Submitting an application through the Service does not guarantee approval. All credit decisions are subject to underwriting criteria, applicable law, and our internal policies, which may change at any time without notice.
If approved, the terms of your line of credit (including interest rate, credit limit, repayment schedule, and fees) will be set forth in a separate credit agreement (“Credit Agreement”). In the event of any conflict between these Terms and your Credit Agreement, the Credit Agreement controls with respect to your line of credit.
4. Intellectual property
All content on the Service — including text, graphics, logos, software, and data — is owned by or licensed to Lumen and protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, or distribute any portion of the Service without our prior written consent, except as expressly permitted for personal, non-commercial reference.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Nothing on the Service constitutes financial, legal, or tax advice. You should consult qualified professionals for advice specific to your situation.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMEN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE SIX MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED DOLLARS ($100).
7. Indemnification
You agree to indemnify and hold harmless Lumen and its affiliates, officers, directors, employees, and agents from any claim, demand, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party right.
8. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Florida, without regard to its conflict-of-law principles. You agree that any dispute arising from or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
You and Lumen agree to attempt to resolve any dispute informally before initiating formal proceedings. Contact us at info@sbaloanoptions.com and we will make a good-faith effort to resolve the matter within 30 days.
9. Changes to these Terms
We may modify these Terms at any time by posting a revised version on the Service. For material changes we will provide notice by email or a prominent in-product notification at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
10. Miscellaneous
These Terms, together with our Privacy Policy and any Credit Agreement you enter into, constitute the entire agreement between you and Lumen regarding the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
